I met lawyer Mr G.Dinagaran through a mutual friend. I had an accident on 4th July 2014. Mr G.Dinagaran had filed my Writ of Summon on 18th September 2014, MC Suit No 17732 of 2014. I suffered permanent back injuries due to an accident. The defendant admitted liability and the matter was referred for damages to be accessed. That is for the court to decide on how much compensation I can receive for my permanent injuries. Mr G. Dinagaran had arranged for 3 doctors to examine me. All 3 doctors are specialists. All 3 doctors confirmed my back injuries were permanent. In particular, one of the doctors testified in court that even if I had gone for physiotherapy and exercises, I would continue to suffer intermittent episodic pain. At the hearing, the Learned Assistant Registrar(AR) held that my injuries were not permanent.
He said “It is also quite clear that the injury is not as serious as the Plaintiff (I) made it out to be and this is evident from the fact that all the doctors merely prescribed rest, medication and physiotherapy. I find Dr James Lee’s opinion that the plaintiff’s disabilities were permanent to be quite unsatisfactory in this regard”
The Learned AR found that the Plaintiff’s disabilities were not permanent contrary to the medical opinion of the Doctors. The learned AR did not call for nor did the defendant produce any medical expert to contradict my doctor but had imposed his own subjective view. In making the finding that the “injury is not as serious as the plaintiff made it out to be” the learned AR disregarded, without the benefit of rebuttal medical evidence, the unchallenged evidence of my doctor on the basis that it was unsatisfactory .I was shocked and I instructed Mr G. Dinagaran to file an appeal. The learned District Judge agreed with the Learned Assistant Registrar and dismissed my appeal on the basis that my appeal is hopeless even though the Defendant did not call any doctors of their own to discredit my Doctors. Mr G. Dinagaran did not stop at that. He was adamant and wanted to fight on to seek a better compensation for my permanent injuries. He appealed to the High Court. In order to appeal we needed leave (permission) from the High Court. He argued at the High Court that the judges at the lower court cannot and must not simply or readily put aside expert opinion especially where the opinion comes from those skilled in the field. The High Court on 5th August 2019 agreed with Mr G. Dinagaran and granted my application. My matter is now fixed for the High Court Judge to decide on the quantum of my injuries. I am sure I will receive a higher award. I thank Mr G. Dinagaran for all his help. He is skillful and knowledgeable.
