Overview

Organisations frequently desire to use promotional material to raise their profile to prospective new clients or the general public. Such material could include images of an individual being published on a press release or a website or airing his opinions about the organisation to third-parties.

However, in generating such promotional material, organisations in Singapore must validly obtain the individual/company’s permission to use their personal data for such publicity purposes so as not fall afoul of privacy laws under Singapore’s Personal Data Protection Act. 

Without a media release form in place, it is possible that an individual might dispute the giving of this consent at a later point in time, and the organisation may find it difficult to prove that it had indeed obtained the requisite consent in order to collect the individual’s data.

A proper media release form will set out the situations under which the individual agrees to have his personal data being utilised and how the organisation will utilise such personal data for its publicity purposes.

Individuals and companies must therefore be informed as to the scope of how the organisation plans to use their personal data.

What is Included in the Template of the Media Release Form?

  • Instructions on how you can use the template;
  • The different methods of how an organisation can acquire an individual/entity’s data (such as taking photos of the individual/entity, interviewing the individual, etc.) and whether the individual would like to opt out of any of these methods;
  • The scope of activities in which the organisation is permitted to use such personal data. The failure of the company to adhere to such personal data for these limited activites will result in it breaching the terms of the media release agreement.
  • Release of claims clause which protects the organisation from any legal action raised by the entity and/or its representative,  so as long as the personal is used in accordance with the agreement;

Clause 1: *(Company name) would like the opportunity to participate in certain PR or publicity activities with you in order to describe your experience, your participation of *(company name) programmes or activities or contents. The purpose of this media release is to describe the activities in which you agree to participate and the use rights of the parties with regard to any documentation resulting from these activities. Unless otherwise agreed to in writing by the parties, this release will apply to all occurrences of the activities you select from the list below.
